Terms of Service

My short version: Skynthesis is yours to use for your own skins, keep your Pro key to yourself, and remember that a skin built on Serum’s factory Default still carries Xfer Records’ artwork, so sharing it is subject to Xfer’s terms too. The formal terms follow.

These terms are an agreement between you and the developer of Skynthesis, a sole proprietor based in California, United States (“we”), for the Skynthesis app for macOS and the website at skynthesis.app. By installing or using Skynthesis, you agree to them. You must be 18 or older, or have a parent or guardian agree to these terms for you.

What Skynthesis is

Skynthesis is downloadable software for making and editing skins for Xfer Serum 2. It runs on Apple silicon Macs with macOS 15 or later and needs a copy of Serum 2, which you buy separately from Xfer Records. Skynthesis is an independent product and is not affiliated with or endorsed by Xfer Records. Serum is a trademark of Xfer Records.

Free and Pro

• Free includes every editing feature and 3 Skyntheses.
• Pro adds unlimited Skyntheses. It is a one-time purchase, not a subscription, and comes as a licence key.
• One Pro key can be active on up to 3 Macs at once. You can deactivate a Mac from inside the app to free up an activation.

Buying Pro

Purchases are sold through Stripe Managed Payments. Link (Stripe) is the merchant of record and the seller of the transaction: you will see “Sold through Link” at checkout and LINK.COM* on your statement, and Link sends your receipt and handles sales tax and VAT. Link’s own buyer terms apply to the payment. Your licence key is shown on the page after checkout. If you lose it, contact us. Refunds and statutory cancellation rights are covered by our refund policy.

Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use Skynthesis on Macs you own or control, within the activation limit above. You may not resell, share or publish your licence key, or remove or bypass the licence check or the Free run limit. You may not redistribute the app itself.

Skins you make

Skins you make with Skynthesis are yours to use. Keep in mind what goes into them:

• Your own images and logos remain yours. Only add pictures you have the right to use.
• A skin built on Serum’s factory Default still contains Xfer Records’ artwork. Sharing or selling such a skin is subject to Xfer Records’ terms, not ours.
• Textures Skynthesize downloads are CC0 or public-domain pictures from Poly Haven, the Art Institute of Chicago and Openverse. Skynthesis records the source and licence of each one.

Updates

The app can check for and install updates from updates.skynthesis.app. We may change, add or remove features in updates. A Pro licence covers unlimited Skyntheses in every future version of Skynthesis, including every future update and upgrade to Skynthesize.

Acceptable use

Do not use Skynthesis or the website to break the law, to infringe anyone’s rights, or to attack or overload our servers, including the waitlist.

No warranty

SKYNTHESIS IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS. We do not guarantee that it will work with every future version of Serum 2 or macOS. Some places do not allow excluding implied warranties, so parts of this may not apply to you.

Limitation of liability

To the extent the law allows, our total liability to you for any claim about Skynthesis is limited to the greater of the amount you paid for it and US$50. We are not liable for indirect or consequential losses, such as lost work or lost profits. Nothing here limits rights you have under consumer law that cannot be waived.

Ending the agreement

You can stop using Skynthesis at any time. If you break these terms, for example by sharing your key publicly, we may stop that key from activating on any more Macs.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. If you are a consumer, this does not take away the protection of the mandatory laws of the country you live in.
